In an interview with Newsday, Myra Creighton discusses the EEOC’s updated guidance regarding COVID-19 workplace standards. The new guidance addresses testing in the workplace and one notable change clarifies whether an employer can administer a COVID-19 test. Myra explains that employers can test if it is job-related and consistent with business necessity. Given these updates, she suggests that employers with a virus testing program review their current policies and “reconsider or re-evaluate whether that program is necessary and meets requirements under the ADA.”
