Employers were handed a holiday surprise late Friday as a federal appeals court breathed new life into OSHA’s ambitious vaccine-or-test Emergency Temporary Standard (ETS). You can be forgiven if you had set compliance efforts to the back of your mind given the time of year and the high likelihood that the court was going to continue to block enforcement – but once again, our workplace lives have been upended. And with OSHA quickly announcing that the first deadline to comply is on January 10 – just a few short weeks away – the time to leap into action is now.
