Privacy and Electronic Discovery in the Digital Workplace
Keeping on top of evolving privacy and electronic discovery issues is a challenge for all employers. The explosion of social media, coupled with mobile technology and emerging case law, has organizations searching for answers.
One of the most dynamic areas of law facing in-house counsel is electronic discovery, particularly in companies that allow employees to “Bring Your Own Device.” Courts continue to issue rulings on new scenarios that provide some flexibility to employers, while at the same time criticizing – and occasionally sanctioning – companies and individuals alike for failing to preserve data, even on personal devices and accounts. This session will address issues which in-house attorneys face involving the challenges of balancing the rights of employers with the rights of employees, and focuses on the steps that all employers can take to manage the risks.
