Overview

Ted Boehm is a partner in the firm’s Atlanta office.  He represents management in all areas of labor and employment law in state and federal courts as well as before state and federal agencies, including the Equal Employment Opportunity Commission and the United States Department of Labor. He is a member of the Firm’s Wage Hour Core Group.

Class and Collective Action Employment Litigation

A significant portion of Ted’s litigation practice includes the defense of class and collective actions.  He has handled numerous collective actions involving claims for unpaid wages pursuant to the Fair Labor Standards Act (FLSA).  His collective action experience includes:

  • Defeating class certification in an FLSA collective action alleging misclassification against a skilled contract labor firm in a case involving more than 500 potential class members;
  • Representation of numerous restaurant employers in FLSA collective actions alleging tip credit violations; and
  • Representation of numerous employers across the industry spectrum in FLSA collective actions alleging off-the-clock work and misclassification.

 Ted also defends employers against single and multi-plaintiff claims of discrimination, harassment, retaliation, and wrongful termination brought under various federal and state laws. Ted has secured summary judgment on behalf of clients in a variety of cases and has successfully argued cases on appeal before the United States Circuit Court of Appeals for the Eleventh Circuit. 

Human Resources Advice and Counseling

In addition to his litigation practice, Ted regularly counsels employers and their managers on "preventive" employee relations. This includes advice on wage and hour compliance, employee relations, harassment investigations, and disciplinary strategies.  Ted drafts employment agreements, arbitration agreements, severance agreements and other employment forms.  He conducts regular employment and wage-hour assessments, as well as management training, for his clients to ensure that they continue to comply with changing laws and regulations.

Representative Clients and Industry Knowledge

Ted is a member of the firm’s Wage Hour Core Group and Hospitality Practice Group. Ted works with a variety of clients, including numerous restaurant employers, to provide practical solutions to day-to-day employment issues.  In addition, Ted has ongoing relationships with several franchisee associations in the quick service and casual dining space.

Community Involvement

Ted provides pro bono legal assistance to Georgia non-profit organizations through the Pro Bono Partnership of Atlanta. In 2019, he was named a “Pro Bono All-Star” by the Georgia Bar Journal. Ted has been named to Georgia Trend’s Legal Elite for Labor and Employment Law on several occasions and previously was listed in Georgia Super Lawyers – Rising Stars.
