Los Angeles Attorney Lays Out the Process for Employers to Engage with Disabled Workers


In his byline article for Corporate Compliance Insights, Los Angeles attorney Devin Rauchwerger discusses how employers can avoid unnecessary disability discrimination lawsuits by properly engaging with their disabled employees. Devin explains that an employer should engage in a good-faith exchange of information to explore the disabled employee’s need for accommodation to establish trust and an open line of communication.

Additionally, Devin says, “The employer should have a clear understanding of the essential functions of the employee’s position,” as a written job description can be used as evidence of what the employer considers essential functions of the job.
