The article, “EEOC Files Novel Suits on Behalf of LGBT Workers,” featured in Law Week Colorado, discussed how federal courts will weigh the commission’s theory that Title VII applies to sexual orientation-based discrimination and harassment.
Larry Lee discussed the EEOC’s position in the case.
“What it comes down to is the EEOC is taking a position that is not explicitly part of the law, but they are interpreting what that law means,” said Larry.
Lee and other employer-side lawyers have seen this move coming. He pointed to not only the EEOC’s strategic enforcement plan and its decision in Baldwin but also the fact that the lawsuits have emerged in an election year, where government agencies under the current presidential administration are “ramping up their programs.”
