Peter was quoted on improvements the EEOC could make to their existing guidelines, so that employers feel less vulnerable to second-guessing by the agency.
The EEOC also could look for a case where it can make a direct employment discrimination claim based on a criminal background check rather than a disparate impact argument, said Peter.
