Overview

Mike has been the primary author of all of Florida's PEO laws, including unemployment compensation (where the PEO can elect to report SUTA under the PEO or its client's rate), workers' compensation exclusivity of remedy, tort reform, Florida's short lived sales tax on services, and Florida's PEO licensing law which is the progenitor of all of this country's PEO licensing laws. Mike and Timothy Tack have represented the vast majority of PEOs for licensure in Florida and when the Florida Board of Employee Leasing Companies ("BELC") has reviewed disciplinary matters brought against licensees, Mike and Tim have been there to provide representation and to protect these PEOs and their ability to continue to furnish unabated service in Florida. Mike and Tim now bring this unique skill set to Fisher Phillips where they will work on a nationwide basis with the esteemed  Fisher Phillips team of PEO attorneys, including Sheldon Blumling and, of course, John Polson. 

Mike remains the General Counsel of FAPEO, where he has served since its inception in 1986. Mike continues to look after Florida PEOs and has assisted the BELC in drafting all of its rules. Most recently, Mike proposed two rules which were adopted by the BELC and which went into effect in December. The first rule eliminated the need for PEOs to prepare and file balance sheets in the 2nd and 4th quarters. The second rule protects PEOs from unnecessary discipline by expanding the BELC's Notice of noncompliance rule. Now there is a procedure in place requiring the BELC to provide first time violators a 30 day cure period before discipline is imposed, with regard to late filing of annual assessments, quarterly reports and annual reports. 

Over the last 35 years Mike has worked with numerous regulators around the country who regulate such diverse industries as mortgage brokers in Michigan, state bank regulators in Nevada, professional engineers in Florida, etc in order for them to better understand the PEO industry and so that unbroken service can continue to be provided to PEO clients working in these industries. 

Many PEOs are not aware that Mike also serves as the first and only Florida Health Care Association Labor Counsel. He has held this position since 1985 and has guided that industry in labor matters ranging from union organizing issues, to collective bargaining, to Wage and Hour matters and to EEOC issues.             

Mike is also actively engaged in his charitable endeavors involving pediatric cancer issues. He serves on the Board of Directors Of CureSearch for Pediatric Cancer, where he also serves on its executive committee, helping to steer millions of dollars of funds to cutting edge pediatric cancer research projects. Mike is always willing to provide advice and counsel to parents of children dealing with the devastating diagnosis of cancer and has recently worked with the FDA and a drug company to make an experimental drug available to a child in need.

In 2018, NAPEO and FAPEO honored Mike by holding a Gala at the Dali Museum in St. Petersburg, Florida benefiting CureSearch. At the Gala, more than $150,000 was raised for children’s cancer research.
